USAGE AGREEMENT

These terms and conditions govern your use of Fill Masjid app and any services or features available through it (collectively, the “Services”). By using the Services, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, you must not use the Services.

Use of the Services

You must not use the Services:

in any way that breaches any applicable local, national or international law or regulation;

in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

for the purpose of harming or attempting to harm minors in any way;

to send, knowingly receive, upload, download, use or re-use any material which does not comply with Fill Masjid content standards;

to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam);

to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

Your account and password

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms and conditions.

Intellectual property rights

Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved.

License to use the app

You may view, download for caching purposes only, and print pages from the app for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.

You must not:

republish material from this app (including republication on another app);

sell, rent or sub-license material from the app;

show any material from the app in public;

reproduce, duplicate, copy or otherwise exploit material on Fill Masjid app for a commercial purpose;

edit or otherwise modify any material on the app; or

redistribute material from this app except for content specifically and expressly made available for redistribution.

Where content is specifically made available for redistribution, it may only be redistributed within your organisation.

Acceptable use

You must not use Fill Masjid app in any way that causes, or may cause, damage to the app or impairment of the availability or accessibility of the app; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use Fill Masjid app to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to Fill Masjid app without our express written consent.

Breaches of these terms and conditions

Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:

(a)    send you one or more formal warnings;

(b)    temporarily suspend your access to Fill Masjid app;

(c)     permanently prohibit you from accessing Fill Masjid app;

(d)    [block computers using your IP address from accessing Fill Masjid app];

(e)    [contact any or all of your internet service providers and request that they block your access to Fill Masjid app];

(f)     commence legal action against you, whether for breach of contract or otherwise; and/or

(g)    [suspend or delete your account on Fill Masjid app].

Where we suspend or prohibit or block your access to Fill Masjid app or a part of our app, you must not take any action to circumvent such suspension or prohibition or blocking[ (including without limitation [creating and/or using a different account])].

Variation

We may revise these terms and conditions from time to time.

Assignment

You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions.

You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.

If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Third party rights

A contract under these terms and conditions is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party.

The exercise of the parties’ rights under a contract under these terms and conditions is not subject to the consent of any third party.

Entire agreement

The terms and conditions, [together with [Fill Masjid App’s privacy and cookies policy]] shall constitute the entire agreement between you and us in relation to your use of Fill Masjid app and shall supersede all previous agreements between you and us in relation to your use of Fill Masjid app.

Law and jurisdiction

These terms and conditions shall be governed by and construed in accordance with [Indian Law].
